NASCAR: Federal judge dismisses Jeremy Mayfield's lawsuit vs. NASCAR

Jeremy Mayfield’s legal challenge, against his NASCAR suspension, for failing a random drug test was dismissed by a Federal Court in Charlotte, North Carolina.

Last year Mayfield was found to have methamphetamines in his system after a NASCAR-ordered test. He claimed the test result was of a combination of using Adderall to treat attention deficit disorder and an allergy medicine, not an illegal drug.

At the time Mayfield was the owner/driver of a Sprint Cup team and subsequently reacted by suing NASCAR for breach of contract, discrimination and defamation of character.

U.S. District Judge Graham Mullen ruled that when Mayfield signed his competition license applications he agreed to governed by NASCAR’s drug testing policy and agreed not to sue NASCAR or its’ officials for publication of results of the random drug testing.

"Plaintiffs thereby waived their right to pursue their claims for defamation, unfair and deceptive trade practices, breach of contract, and negligence," Graham Mullen wrote in his decision. "Plaintiffs' claims are hereby dismissed."

In a written statement NASCAR reacted to the dismissal “The U.S. District Court’s ruling is a powerful acknowledgement and affirmation of NASCAR’s rulebook and its ability to police the sport. NASCAR has been very clear with its competitors as to its policies and what is expected of them. NASCAR’s comprehensive substance abuse policy, which is among the best and toughest in all of sports, serves the safety of our competitors and fans.”

Jeremy Mayfield has not issued a reaction, awaiting word from his attorney, but he has the option of appealing the Judge’s decision to the United States Court of Appeals.

NASCAR filed a counterclaim against the Mayfield complaint but has not made a decision on its’ future advising various news outlets that it was still evaluating its’ options.
